These terms apply to the use of nightgrovelighting.com and to lighting design, installation and maintenance work performed by Nightgrove Lighting Co., a division of Lemar Street Properties LLC ("Nightgrove," "we," "us").
Your written proposal comes first. Every project is quoted with a fixed price in a written proposal. Where anything in that signed proposal or contract differs from these terms, the proposal governs for that project. These terms fill in what the proposal does not cover.
The on-site design consultation is free and carries no obligation. After it, we provide a written proposal setting out the scope, the fixtures, and a fixed price.
A proposal is valid for 30 days from its date unless it says otherwise. Fixture availability and pricing can move; if a fixture specified in your proposal becomes unavailable, we will tell you and offer an equivalent before ordering.
Work begins once you accept the proposal in writing. Anything added after that — extra fixtures, extra runs, additional zones — is quoted and agreed separately before we do it.
The price in your accepted proposal is fixed for the scope described in it. It does not cover work we could not reasonably have foreseen — for example, rock or obstructions found during trenching, or a pre-existing fault in wiring we are asked to connect to. If we hit something like that, we stop and tell you what it means for the price before continuing.
Payment terms, including any deposit and the balance due on completion, are set out in your proposal. Invoices are due on the terms stated on the invoice.
Installation dates are scheduled in advance and depend on weather and ground conditions. Trenching and aiming work are weather-dependent, and we will reschedule rather than install in conditions that would compromise the result.
You agree to provide safe access to the property and to the power source on the agreed dates, and to tell us about anything on site we would not otherwise know about — irrigation lines, invisible pet fencing, septic fields, buried utilities on private land, pets, or security systems.
Aiming is done after dark. Most installations include a night walk, and that visit is part of the job rather than an extra.
We install low-voltage (12V) systems. Where a project requires line-voltage circuit or panel work, we coordinate that portion with a licensed New Jersey electrician rather than performing it ourselves.
Before any digging we take reasonable care to locate what is underground, and you are responsible for telling us about private buried lines that public utility markouts do not cover — irrigation, landscape drainage, invisible fencing, low-voltage runs installed by others. We are not responsible for damage to unmarked private lines we were not told about, though we will always tell you promptly if something is hit.
We are not responsible for the condition or performance of systems installed by others that we are asked to connect to, extend or repair.
Every installation carries a two-year warranty on our workmanship from the date the installation is completed. If a connection we made, a run we buried, or a fixture we mounted or aimed fails because of how we installed it, we come back and put it right at no charge.
The workmanship warranty does not cover:
The warranty covers the original installation at the original property and does not transfer automatically on sale of the property. Ask us and we will consider transferring it.
Fixtures carry their manufacturer's warranty, which sits on top of our workmanship warranty and is separate from it. Terms and length vary by manufacturer and by fixture. Where a fixture fails within its manufacturer's warranty, we will handle the claim with the manufacturer on your behalf; labour for that swap is covered within the first two years under our workmanship warranty.
Care plans are optional annual maintenance agreements covering scheduled visits, re-aiming, cleaning and system checks. What is included, how often we visit, and the price are set out in the care plan agreement. Care plans renew annually unless you tell us otherwise, and you may cancel a renewal before the next term begins.
You may cancel a scheduled consultation or service visit at any time; we ask for as much notice as you can give. Cancellation of accepted installation work after fixtures have been ordered or materials purchased is handled as set out in your proposal.
Where New Jersey law gives you a right to cancel a home improvement contract within a set period after signing, that right applies regardless of anything in these terms, and your contract will say so.
We photograph completed installations and may use those photographs on this website, in proposals and on social media. We do not publish your name, your street address or anything that identifies you or the property's exact location. If you would rather we did not photograph your property at all, tell us and we will not.
We stand behind our work as described above. Beyond that, and to the extent the law allows, our total liability arising out of a project is limited to the amount you paid us for that project, and we are not liable for indirect or consequential losses.
Nothing in these terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Nothing in these terms removes rights you have under New Jersey consumer protection law.
These terms are governed by the laws of the State of New Jersey, and any dispute will be brought in the state or federal courts sitting in New Jersey.
